When I first saw the WSJ article (on Twitter) and put a blog entry together (about 2:20pm, Saturday afternoon) I was willing to believe that more needed to come out but that the issue of these kinds of interactions, and Prosser's history of name calling, etc., unfortunately made it too believable.  I can only wonder if he has always been like this or is it a more recent expression of personality - draw your own conclusion!  What has been universal is as I related what was reported, that people said, "That can't be true!?"

Was it that people did not believe me or my account?  No, I don't think so.  They were offended, affronted, shocked, astounded - pick your adjective or adverbs (if you are really stunned)!  This was the behavior of a Wisconsin State Supreme Court Justice.  How could he be elected.  How could he be capable of this kind of "stunt".  He evidently is living pretty close to the edge - ~750,000 people in this state better do a little self-reflection before they simply vote ideology without really knowing the candidate.

By later in the day or early evening the situation had become even a little more strange.  I gather Prosser came out first with a "self-defense" argument such that Bradley had to at least counter with her own statement of incredulity.

Prosser should resign but he will not.  He is the precursor of Scott Walker: fostered, selected into, cultivated and promoted by the Republican Party of Wisconsin.

Prosser seems to not have much decorum left.  If this turns out to be a faithful and truthful account he should resign.

Wisconsin Supreme Court Justice David Prosser allegedly grabbed fellow Justice Ann Walsh Bradley around the neck in an argument in her chambers last week, according to at least three knowledgeable sources.
Details of the incident, investigated jointly by Wisconsin Public Radio and the Wisconsin Center for Investigative Journalism, remain sketchy. The sources spoke on the condition that they not be named, citing a need to preserve professional relationships.
They say an argument that occurred before the court’s release of a decision upholding a bill to curtail the collective bargaining rights of public employees culminated in a physical altercation in the presence of other justices. Bradley purportedly asked Prosser to leave her office, whereupon Prosser grabbed Bradley by the neck with both hands.

RECOUNT ALERT! SERIOUS BREAK IN CHAIN OF CUSTODY IN WAUKESHA COUNTY!

What is this all about?  Waukesha keeps providing excitement?!  From the source -

"At around 2:15pm, we were ready to open the bags for Delafield. There were three bags total. Bags 1 & 2 were fine. The numbers all matched up. When we got to bag 3, we found out that the bag # was NOT RECORDED ON THE INSPECTOR'S statement...! The Republican canvass person said we could assume that the clerk forgot to write the # down on the inspector's statement and we could proceed. Of course, this is a break in the chain of custody!..."

So Bill (volunteer lawyer) objected. I got my phone out and went to call the campaign. The sheriff wouldn't let me out the back door (even though I went out that door to use the restroom earlier) but made me go around everyone to the front door (front door is for reps, back door is for public). I had to get past the guy sitting out front wanting to know if I was leaving for the day, what my name was...

I gather after Thursday Sumi (TRO - Open Meetings) can't be overruled!  The request to vacate, as I recall, is in regard to DOJ filing that Sumi exceeded her authority!

Once the canvass had been completed and the results were finalized, I was called into Kathy�s office along with Pat (the Republican observer) and told of an impending 5:30pm press conference. It was at that point that I was first made aware of an error Kathy had made in Brookfield City. Kathy told us she thought she had saved the Brookfield voter information Tuesday night, but then on Wednesday she said she noticed she had not hit save.  Kathy didn�t offer an explanation about why she didn�t mention anything prior to Thursday afternoon�s canvass completion, but showed us different tapes where numbers seemed to add up, though I have no idea where the numbers were coming from. I was not told of the magnitude of this error, just that she had made one. I was then instructed that I would not say anything at the press conference, and was actually surprised when I was asked questions by reporters.

In a recent CapTimes:Mailbag (3/27) three examples were given as to how “Democrats tell whoppers!”. As rhetoric it is a very good piece. You must read it very carefully!

In example one the point is made that public workers are only a small part of the middle-class, etc., and that somehow elected officials and unions bargaining with each other is corrupt. This would require all elected officials to be Democrats (or union members themselves) and thus unions are being served by those they elect and that the non-union voters or other issue voters have no impact on elections, either that or some Republicans and independents are corrupt too, or at least in a marginalized minority.

In example two the point is made that Democrats claim collective bargaining represents a basic right. Basic right seems to mean different things, sometimes associated with constitutional or human rights or labor rights, etc. What does it mean in this case – probably more akin to something like a right established by tradition or generational wisdom, such as in British Common Law. The example goes on to say that public and private unions require a fee to be paid to get or maintain a job (I'm not sure which is meant, probably the latter in terms of dues?) and that it is unsavory. That is just not an accurate way to characterize the situation – but the short-hand is comprehensible anyway! Please take note that in example one union members by default logic are either members of the upper-class or the lower-class (or perhaps neither) but an insignificant part of the middle-class.

In example three the point is made that JoAnne Kloppenburg is not an independent but a Democrat and thought to be by Democrats an antidote to Walker's policies. Has JoAnne Kloppenburg said she was a Democrat? A rhetorical question – If you are an independent and do not favor Walker's policies who would you vote for? If you are a Democrat and do not favor Walker's policies who would you vote for?

Was it perhaps all tongue in cheek?

In 2006 there were 831,567 votes cast in the Supreme Court Election. In 2008 there were 827,899 votes cast (see WI GAB for all numbers mentioned plus my arithmetic) for the Supreme Court Election.
 
Michael Gableman got 425,101 votes and sitting Justice Louis Butler got 402,798 votes - 51.19% to 48.50%.  In the previous Governor's election the following numbers apply -

Wisconsin Voter Turnout 11/2010      49.56%    2,160,832    
VAP   4,330,695

         Wisconsin Voter Turnout 11/2008      69.20%    2,996,869
